Terms of Service

These Terms govern your use of PixiePinesPress (“we”, “us”) and any services delivered through this website.

1) Services

PixiePinesPress provides productized website services (e.g., one-page “bio” sites, multi-page brand sites, starter shop setups), plus optional ongoing maintenance via the “Pixie Care Plan”. Work is delivered async (email/Loom) unless explicitly agreed otherwise.

2) Packages, scope and revisions

• Scope is defined by the package description on the website and the written scope confirmation (email).
• Revisions included depend on package (typically 1–2 rounds). Additional changes are quoted.
• Out of scope items include (unless agreed): custom app development, complex automations, custom illustrations, full copywriting from scratch, multi-language expansion beyond agreed pages.

3) Prototype option (48h)

The “48h prototype” is an accelerated first version intended to validate structure, layout and direction. Timelines assume timely access to required assets (logo, images, product categories, links, preferred CTA). If assets are delayed, timelines shift accordingly.

4) Client responsibilities

• You confirm you have rights to use all assets you provide (logos, images, fonts, copy, brand elements).
• You provide accurate information and respond to questions/revision requests within a reasonable time.
• You are responsible for legal compliance of your content and business (e.g., product claims, licenses, consumer terms).

5) Payment terms

• Website builds are a one-time fee: typically 50% deposit to start and 50% before go-live/handover.
• Prices shown are generally exclusive of VAT unless stated otherwise.
• Invoices are payable as stated on the invoice. Late payments may pause delivery until resolved.

6) Pixie Care Plan (subscription)

• Care Plan includes hosting/maintenance as described on the site. Higher tiers may include small monthly content changes.
• When included as a “30-day included period”, Care starts after launch and lasts 30 days.
• After the included period, Care renews monthly unless you cancel by email before the next billing cycle.
• Care does not include major redesigns, new pages, or major features unless quoted separately.

7) Hosting, domains and third-party services

Hosting can be on Namecheap cPanel, Netlify or Vercel (or another provider by agreement). You retain ownership of your domain and accounts, unless explicitly agreed otherwise. Third-party providers may have their own terms and policies.

8) Delivery, acceptance and handover

• We deliver work as a live link or deployed site and/or as files, depending on the package.
• When the final payment is received, we provide handover details as agreed (files, access instructions, documentation).
• Minor issues reported shortly after launch are handled under the included Care period (if applicable) or quoted if outside scope.

9) Intellectual property

• Upon full payment, you receive the deliverables for your business use (site files/design as delivered).
• We may reuse generic non-client-specific components/know-how in other projects.
• If you request removal of any portfolio mention, contact us and we will consider it in good faith.

10) Portfolio

Unless otherwise agreed, we may reference completed public-facing work in a portfolio (e.g., link + short description). We will not disclose private information, credentials, or non-public analytics without your explicit permission.

11) Disclaimers

• We do not guarantee specific sales, rankings, ad performance or revenue outcomes.
• We aim for best practices (speed, structure, SEO basics), but final results depend on market, offer, traffic sources and business execution.
• Third-party outages, policy changes or platform updates are outside our control.

12) Limitation of liability

To the maximum extent permitted by law, our liability is limited to the fees paid for the relevant service. We are not liable for indirect or consequential damages (lost profits, lost business, etc.).

13) Termination

• Either party may terminate a project if the other party materially breaches these Terms and does not remedy within a reasonable time after notice.
• If a project is terminated mid-way, fees already paid cover time spent and delivered work to date. Any further refunds are at our discretion unless required by law.
• Care Plan can be cancelled by email (effective next billing cycle).

14) Governing law

These Terms are governed by the laws applicable to the Provider’s business location (Netherlands), unless mandatory consumer rules apply otherwise.
