Parties and business use
PixiePinesPress is a specialist brand within Werstler Digital Studio, currently operated by Jarek Werstler in the Netherlands. These Terms apply to website design, development, hosting, maintenance, reviews and related services supplied to businesses, self-employed professionals and organisations. Consumer projects are accepted only under a separate written agreement.
Project Agreement and acceptance
A project starts after the client accepts the written proposal or signs the Project Agreement. That document records the selected plan, 12- or 24-month term, monthly price, included pages, content responsibilities and start date. The signed Project Agreement takes priority over these website Terms where the two differ.
Fixed payment term
The standard plans run for either 12 or 24 months. The monthly price remains fixed during the agreed term unless the client approves additional work, the scope changes or a tax or legal requirement changes. The service does not automatically renew for another fixed term. Any post-term care plan requires separate written acceptance.
Standard website scope
The standard service is a static, custom-coded brand website built with HTML, CSS and JavaScript. The selected plan determines the number of pages and monthly content updates. Online stores, carts, checkout, payment processing, booking systems, user accounts, web applications and a client editing dashboard or CMS are excluded unless a separate written proposal explicitly states otherwise.
Domain, hosting and third-party costs
One standard domain costing up to €25 per year is included and will be registered using the client’s ownership details where the registrar permits. PixiePinesPress may administer DNS and renewals during the agreement. Premium or aftermarket domains, extra domains, email mailboxes, paid fonts, stock media, plugins, licences and external subscriptions are not included unless written into the Project Agreement.
Hosting and technical care
During the payment term, the monthly price includes the agreed hosting, SSL, DNS support, reasonable backups, basic security care and ordinary technical maintenance. No hosting service can guarantee uninterrupted availability. Planned maintenance and failures caused by third-party infrastructure, registries, internet providers or events outside reasonable control are not a breach of these Terms.
Small content updates
A small content update means replacing existing text, images, links or product information without changing the layout or adding functionality. One request may take up to 30 minutes. The monthly allowance is 1 request for Starter, 2 for Brand and 4 for Studio, unless the Project Agreement states otherwise. Unused requests do not roll over and cannot be combined into a redesign or new feature.
Payments and late payment
Invoices are due on the date stated on the invoice. If payment is late, PixiePinesPress may send a reminder and pause work, content updates, support or non-essential active services until the account is current. Statutory interest and reasonable recovery costs may be charged where permitted by law. Pausing service does not remove amounts already due.
Client materials, feedback and delays
The client must provide accurate content, lawful images, required account access and consolidated feedback on time. The client confirms it has permission to use all supplied materials. Delayed content or feedback moves the delivery schedule. If the client is unresponsive for 30 days, the project may be marked dormant and rescheduled; agreed monthly payments continue unless a written pause is approved.
Cancellation and early exit
Because design and build work is concentrated at the start, cancelling the project does not automatically cancel the fixed payment commitment. Any early-exit or buyout option must be agreed in writing and will be stated in the Project Agreement. If no early-exit option is stated, the remaining payment obligation continues to the extent permitted by law. PixiePinesPress may terminate for material breach after reasonable written notice and an opportunity to correct it.
Ownership and handover
Client-supplied content remains the client’s property. After cleared receipt of the final agreed payment, PixiePinesPress will provide the completed website files within 14 days and reasonably assist with handover. The transfer excludes non-transferable third-party licences, internal working files, general methods and reusable non-client-specific code. Hosting continues for up to 30 days after handover unless a separate care plan is accepted.
Portfolio and confidentiality
Unless the Project Agreement says otherwise, PixiePinesPress may identify the client and display the public website in its portfolio after launch. Confidential information shared for the project will not be published. Either party may request a written confidentiality or delayed-publication arrangement before work begins.
Results, warranties and liability
PixiePinesPress does not guarantee rankings, traffic, sales, revenue or compatibility with future browser, device or third-party changes. The client must review and approve content before launch. To the extent permitted by law, total liability arising from the relevant service is limited to the amount paid for that service during the six months before the event giving rise to the claim. Liability is not excluded where exclusion is not legally permitted.
Governing law and changes
Dutch law applies, and disputes will be submitted to the competent court in the Netherlands unless mandatory law requires otherwise. Changes to these public Terms apply to new work and future renewals; they do not silently replace a signed Project Agreement already in force.
